Terms of Use

Effective Date: October 12, 2026  |  Last Updated: October 12, 2026

These Terms of Use ("Terms") are an agreement between you and CareMatch LLC ("CareMatch," "we," "our," or "us") and govern your use of the CareMatch mobile application, the website at carematch.app, and related services (the "Services"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Please read Section 14 carefully. It requires most disputes to be resolved through individual arbitration and includes a class action waiver.

1. Eligibility

  • You must be at least 18 years old and able to form a binding contract to create an account.
  • Caregivers must be at least 18 years old.
  • The person receiving care may be any age. If care is for a minor or for an adult who cannot manage their own account, the account must be created and managed by a parent, legal guardian, or other person with legal authority to make care decisions for them. You confirm that you have that authority.
  • You may not use the Services if you have been removed from CareMatch before or if you are prohibited from doing so by law.

2. What CareMatch Is and Is Not

CareMatch is a technology platform that helps people seeking non-medical care ("Care Seekers") and people offering caregiving support ("Caregivers") find and connect with each other.

CareMatch is not a home care agency, nurse registry, employer, staffing service, or health care provider. We do not:

  • Employ, hire, assign, train, supervise, or control Caregivers.
  • Schedule care, set rates, or manage any care arrangement.
  • Process or hold payments between users.
  • Provide medical care or medical advice.

Caregivers are not employees or agents of CareMatch. Any arrangement you make with another user is solely between you and that user. You are responsible for deciding whether an arrangement is right for you and for meeting any obligations that apply to it, including employment, tax, insurance, and licensing requirements.

3. Caregiver Verification and Your Own Due Diligence

Caregivers must complete an identity verification step, which may include submitting a government issued ID, before appearing in matches. Identity verification confirms identity only. It is not a criminal background check, reference check, employment history check, or license or credential check.

CareMatch does not guarantee the identity, qualifications, conduct, or suitability of any user. Before arranging care, especially for a child or a vulnerable adult, you should conduct your own background check, check references, confirm any licenses or certifications, and take reasonable safety precautions.

4. Your Account

  • Provide accurate, current information and keep it up to date.
  • Keep your login credentials confidential. You are responsible for activity on your account.
  • Do not create more than one account or an account for anyone else unless you are their parent, guardian, or authorized representative as described in Section 1.
  • Only share information about a care recipient that you have the right to share.

5. Rules of Conduct

You agree not to:

  • Use the Services for any illegal purpose or in violation of these Terms.
  • Harass, threaten, exploit, abuse, or harm any person, or engage in any conduct that endangers a child or vulnerable adult.
  • Impersonate anyone or misrepresent your identity, age, qualifications, or affiliation.
  • Post false, misleading, discriminatory, sexually explicit, or harmful content.
  • Ask other users for money, financial account information, or gift cards, or run scams.
  • Collect information about other users without their consent, or use the Services to advertise unrelated products.
  • Offer or request medical services that require a license you or the other party do not hold.
  • Interfere with, scrape, reverse engineer, or disrupt the Services.

We may remove content, suspend, or terminate accounts that we believe violate these Terms or create risk to users. You can report a user or content through the app or by emailing [email protected].

6. Your Content

You own the content you post. You give CareMatch a non-exclusive, worldwide, royalty free license to host, display, and use your content to operate and improve the Services. You are responsible for your content and confirm that you have the right to post it.

7. Subscriptions and Payments

  • Basic: free, with limited swipes.
  • Premium: an optional subscription for $9.99 per month (plus any applicable taxes) that provides additional swipes and features.

Automatic renewal. Premium renews automatically each month at the then current price, and your payment method is charged at the start of each billing period, until you cancel.

Where you buy matters. Subscriptions purchased in the app are billed and managed by Apple or Google under their terms. Subscriptions purchased on our website are billed by CareMatch through our payment processor, Stripe.

Cancellation and refunds. You can cancel anytime. Cancellation stops future charges, and Premium remains active until the end of your current billing period. Payments are non-refundable except as stated in our Refund and Cancellation Policy or as required by law.

Price changes. We will give you advance notice of any price change, and the new price applies at your next renewal after the notice. You can cancel before the change takes effect.

8. Safety

You are responsible for your interactions with other users. We recommend meeting in a public place or with a trusted person present for a first meeting, never sending money to someone you have not met, and contacting local emergency services if anyone is in danger. CareMatch is not an emergency service.

9. Intellectual Property

The Services, including the CareMatch name, logo, the Cool Nana character, design, and software, are owned by CareMatch LLC or its licensors and are protected by law. You may not copy or use them except as allowed by these Terms.

10. Termination

You may delete your account at any time. We may suspend or terminate your access at any time if you violate these Terms or if we believe your use creates risk for others or for CareMatch. Deleting an app does not cancel a subscription; see Section 7.

11. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent permitted by law, CareMatch disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. CareMatch does not warrant that any user is who they claim to be, that any match will result in a care arrangement, or that the Services will be uninterrupted or error free.

12. Limitation of Liability

To the fullest extent permitted by law, CareMatch and its members, managers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Services or from the conduct of any user on or off the Services. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid CareMatch in the 12 months before the claim or $100.

Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Indemnification

You agree to defend and indemnify CareMatch from claims, losses, and expenses (including reasonable attorneys' fees) arising from your content, your violation of these Terms, or your interactions or arrangements with other users.

14. Dispute Resolution and Arbitration

Informal resolution first. Before filing a claim, you agree to email [email protected] with a description of the dispute and give us 30 days to try to resolve it.

Arbitration. If we cannot resolve it, any dispute arising from these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration may be conducted by video or phone, or in person in your county of residence or another mutually agreed location.

Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for misuse of intellectual property.

Class action waiver. You and CareMatch agree to bring claims only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding. You and CareMatch waive the right to a jury trial.

Opt out. You may opt out of this arbitration agreement by emailing [email protected] within 30 days of first accepting these Terms.

15. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law rules, except where the law of your state of residence requires otherwise.

16. Changes to These Terms

We may update these Terms. If changes are material, we will notify you through the Services or by email before they take effect. Continued use after the effective date means you accept the updated Terms.

17. General

These Terms, together with our Privacy Policy, Cookie Policy, and Refund and Cancellation Policy, are the entire agreement between you and CareMatch about the Services. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent.
